TERMS & CONDITIONS – ONLINE BUYBACK AND GOLD SELLING SERVICE

These terms and conditions govern our online buyback and gold selling valuation service and the transportation of Your Property (defined below) to and from us (“Terms”).


By using our online Buyback and gold selling valuation service, posting your Property to us, regardless of whether you have signed the Customer Declaration with or without Buyback option that is sent out to you with the GoldPlus posting pack, you are making a legally binding contract with us governed by these Terms. No other person shall have any rights to enforce these Terms between you and us.


These terms set out; your legal rights and responsibilities; our legal rights and responsibilities; and certain key information required by law.


In these Terms, “Authorities” means any court, legal or regulatory authority, or legal enforcement agency including the police.


“GoldPlus”, “we”, “us” or “our” means ALM (GB) Ltd t/a GoldPlus.


“Site” means gold-plus.co.uk and all associated web pages.


“You” or “your” means the person using our Site to use our online Buyback and gold selling valuation service.


Every customer must be at least 18 years of age to sell items to GoldPlus. You must be the actual legal owner of all gold, Jewellery and other property sold or attempted to be sold to GoldPlus. Every customer must be acting on his or her own behalf and not as the agent or representative of another person.


You will be asked to provide documentation of proof of identification that complies with the requirements contained in these T’s & C’s.


We ask that you provide photo ID. We also require proof of address ID that is within 8 weeks old. We only accept official identification e.g., valid driver’s licence, passport or other official photo ID and a bank statement, council tax letter, utility bill.


ID will only need to be supplied on acceptance of a valuation offer. This can be printed and sent via the post, via email or via WhatsApp. Any material sent to us via the internet cannot be guaranteed to be completely secure as they are subject to possible interception or loss or possible alteration. We cannot be responsible for any message lost, intercepted, or altered by third parties and will not be liable to you or anyone else for any damages or otherwise in connection with any message sent by you to us or any message sent by us to you over the internet.


Personal data will automatically be kept on our database for a maximum of six years as stated in our privacy policy, however, this does not affect your privacy rights as per GDPR.


You guarantee that no items sent to us are the result of illegal activity in the UK or any other country; that any transaction initiated by you will not cause Goldplus to be in violation of any anti-money laundering, antiterrorism, or their applicable law of any country; not to send any hazardous material to us and not to send us any material that does not contain precious metals.


All items sent to us must be via Royal Mail Special Delivery. All items posted to us are at your own risk. It is your responsibility to obtain and retain a receipt showing tracking code for posting with Royal Mail via Post Office. This receipt will be required as well as any other supporting documentation and photographs of items should there be a need for any insurance claim.


It is your responsibility to keep safe all documentation relating to your property that would be useful in support of an insurance claim, including, but not limited to any purchase receipts, shipping receipts, certificates, valuations, insurance documents or photos.


Please note the following clause [from Royal Mail’s insurance claim processes]: “Royal Mail needs to ensure that unwarranted claims are not made and as such it retains the right to request further information from the claimant and to refuse claims that it suspects are unwarranted”.


Subject to the terms of Clause 4 above, you agree that we are not liable in any way if Royal Mail refuse any insurance claims in relation to your property. The items are insured by Royal Mail for up to £750 whilst in transit to Goldplus.


If you wish to increase the insurance level to either £1000.00 or £2500.00 you must pay an additional fee at the Post Office. If we buy the items via our online Buyback or Gold selling service, we will refund the cost of the increased insurance provided that the items you have sent in the insured pack do have a higher value than £750. We will need to see the receipt from the Post Office before this refund can be processed. If for any reason we do not buy your items, no refund will be made against any extra insurance you may have taken out.


You must list the quantities and description of the items you are sending us on the form provided and complete your details in full and sign the Customer Declaration of ownership.


Goldplus reserves the right to reject any forms and the included items which are not properly completed and signed. We also reserve the right to reject delivery of any package which appears to be opened, damaged, or tampered with in any way. Any packages we reject will be returned to you at our cost but without any liability to Goldplus.


We have obligations if we suspect items, we have received are fraudulent, counterfeit, stolen, or the proceeds of crime. You acknowledge that as a result, we may be required to retain, surrender, or destroy such items. If we are obliged to retain, surrender, or destroy your items pursuant to this clause, we shall have no liability to you for doing so. We will try to inform you of our actions under this clause unless we are requested not to do so by the Authorities.


On safe receipt of your precious metals posting pack a recording will be made opening and cross checking the items against completed form. This recording will be kept until either our valuation offer has been accepted and paid to you or in the unlikely event of you not accepting our offer, the items have been returned and received by you. This recording can be made available to you on request.


Your items may be tested by our trained experts to determine their value, based on that day’s precious metal markets. This process may involve using either acid, filing or electronic testing. You accept that the valuation process may result in tarnishing, staining and/or scratches. By sending us your items you accept this process, and we are not liable for any damage or diminution in value to your property because of this process.


Goldplus accepts gemstones. However, it may cost more to remove a gemstone from its setting than its value to us, therefore they have no intrinsic value. Should a gemstone of significant intrinsic value be identified, this will be considered when making an offer.


We will endeavour to contact you by telephone or email with an offer which will be valid until 5pm that same day. The valuation offer may be subject to change if we are unable to reach you on that day. This is because the gold fix and other precious metals prices change daily. Once we have spoken to you and confirmed that you are happy to accept our offer, we will pay by bank transfer into your nominated UK bank account which we will confirm by email.


In exceptional circumstances we will make cash payment; however, we will deduct the delivery costs from your payment. If returned items or cash payment are not able to be delivered by the Royal Mail because they have been unable to obtain a signature, they will leave an instruction card. If the package is returned to the local delivery office, it will need to be collected within a period specified by the Royal Mail. If, however, the package is not collected within this time, it will be returned to us. On receipt of the returned items or cash payment, we will endeavour to contact you to arrange for the items to be re-sent, however there will be a charge of £20 to cover the additional postage and administration costs.


Once an offer is made and accepted the items cannot be returned. If after 28 days, we have been unable to contact you we will send payment for your items to the name and address provided. If you do not want to accept the offer you have 7 days to return the payment plus an administration and storage fee and your items will be returned to you. If you have not returned relevant payment within this time, we will assume the offer has been accepted and the items will sold/scrapped where appropriate. For returned items that have been sent back to us because they have not been collected after delivery has been attempted, payment must be received within 21 days of contacting you or we reserve the right to purchase the items at our current gold price with a deduction of £20 for our administration costs and storage and insurance fee of £5 per week.


Subject to the other provisions of these Terms, if you or we decide not to enter into a Buyback agreement or immediate sale we will despatch your property back to you within 5 working days of you or us notifying the other that we will not be entering into a Buyback or immediate sale agreement. You will receive email confirmation of despatch, including your tracking code on the day of despatch. If you decide to enter into a Buyback agreement with us, we will arrange for the items that you have sold to us under the Buyback scheme to be returned to you in accordance with the buyback agreement.


If you decide to resend us the items, please be aware as the gold prices fluctuate daily. We cannot guarantee your original offer; however, it could work in your favour if the applicable metal price was to rise. We will return the items free of charge, however if the same items come back to us again or under a different name/account there will be a £20 fee to return them. Your payment must be received within 28 days, or the items will be disposed of.


If you send items (knowingly or unknowingly) containing no precious metals, there is a minimum £20 fee for returning them, or we can dispose of them free of charge. Your payment must be received within 28 days, or your items will be disposed of.


If items are sent to us without a completed customer form, it is unlikely we will be able to identify the sender unless the name and address has been written in the Special Delivery envelope. We will hold these items for a period of 6 months in a secure area. Customers claiming items will be required to provide a full and detailed description before and offer is made. Once we have confirmed a successful lost property claim, we will make payment for items at our current price, If the items have been held more than 3 months, a deduction will be made from this payment to cover our storage and administration costs. If a claim is not made within 6 months, the items will be refined to recover our storage and insurance costs of £5 per week. If a claim is made after the items have been refined, a payment will be made for any outstanding amount due.


If you wish to submit a claim to Goldplus, you must notify Goldplus immediately to request a claim form. To be processed, the claim form must be fully and accurately completed, signed, and posted to Goldplus in accordance with the claim form instructions. You must submit any and a supporting documentation with the completed and signed form. Failure to properly complete, sign and post the claim form may result in the denial of the claim by Goldplus. There is a 14-day processing period from the time the claim form is received by Goldplus and the claim processed. Your statutory rights remain unaffected.


We will not be liable for anything that is not caused by us or in our control, such as any loss or damage caused by a carrier, your inadequate packaging or failure to address a package correctly, or us having to carry out legal obligation in respect of your property.


If items are sent to us in error, our special delivery envelopes are coded with a unique licence and are for customers sending precious metal with the intent to sell. If you use our special delivery envelope to send items intended for someone else, they will be sent to us. The fee for returning these items is £20, this covers the postage, insurance, and administration costs. All phone calls between Goldplus and its customers or potential customers may be recorded for security and training purposes. Any such recording may be relied upon by Goldplus in the event of any dispute.


This Agreement shall be governed by the laws of England and Wales. Goldplus’s failure to exercise or enforce any right or provision of these T’s & C’s will not be deemed to be a waiver of such right or provision. If any provision is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court shall endeavour to give effect to the parties’ intentions as reflected in the provision and the other provisions of these T’s & C’s will remain in full force and effect. Customers agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or relate to use of the services offered by Goldplus must be filed within one year after such claim or cause of action arose. Any such claim or cause of action must be filed in the UK.


You agree to indemnify and hold harmless Goldplus against all liability, claims, suits, losses, costs, and legal fees caused by, arising out of, or resulting from any breach or claimed breach by you of these T’s & C’s, including claims brought by third parties. Goldplus reserves the right to change these T’s & C’s and advise you to revisit our website, at gold-plus.co.uk periodically to ensure that you are aware of our current T’s & C’s. If a customer sends items more than once, it is your responsibility to check the T’s & C’s on every separate occasion that you choose to send us precious metal and/or jewellery items to ensure your awareness of our current T’s & C’s which you agree to be bound by sending subsequent items to us.


Goldplus complies with all requirements of the Data Protection Act. Your information will only be used if you have given us permission to do so. Any bank account or similar details you provide will be treated confidentially and will only be stored subject to high security methods and only if we have your permission in advance.


ALM (GB) Ltd t/a Goldplus is a UK business and only accepts precious metals and/or jewellery items from UK addresses and only pays to UK accounts.
